My son also has cerebral palsy, and used a walker until he was 9 years old. I am convince if they had taken his walker away, he would have never started to walk. The school district we were in also thought they knew best about my child, and we had many meetings, many disagreements, it caused a lot of stress, but my husband and I felt it was always a fight worth fighting. You keep fighting Kristi, and shame on Gary Lemley. I'm thinking that perhaps it could even possibly be the fault of the school, if the walker collapsed, could it be that someone didn't engage the locking mechanism?
You will always have to be an advocate for your child, as long as you are alive there will be situations where you will have to intercede, from Social Security, to Medicaid, to a soul less salesman trying to take advantage. Never let anyone tell you they know better than you, about the needs of your child. My son is now 28, he still has falls, but he gets up and puts on his own Band Aids. He drives, works, and pays taxes, he is also going to college. You are doing the right thing, if you have to sue the school district, do it now, don't wait until she's older, thinking things will get better, they will always be trying to make you feel you are wrong about something. Parents have far more rights than the district to like you to thing. It's possible you could find someone to represent you through the Legal Aid system, or any one of the numerous advocacy groups for the rights of disabled people. Good luck to you.
