It’s getting messy! Kelly Rutherford has been granted a temporary restraining order against her ex-husband, Daniel Giersch.

According to documents filed in L.A. County Superior Court, the “Gossip Girl” actress claims Daniel has repeatedly harassed both her and their nanny, which she claims forced the nanny to quit.

“Daniel has begun to follow me, my mother, my nanny and he shows up unexpectedly to threaten and scare us,” Kelly states in the documents.

It is also claimed that Daniel “has harassed [my nanny] with questions about me virtually every time he sees her … last week Daniel’s harassment of [the nanny] led to an actual threat that he is going to file a lawsuit against her.”

Kelly says the nanny handed in her pink slip after that, causing her two kids — Hermes and Helena – to lose someone they “love and trust.”

Kelly’s mother, Ann Edwards, is also quoted in the documents, claiming the German businessman once arrived at a restaurant where she was eating with the couple’s two-year-old son, Hermes, and blocked them from leaving the establishment.

The restraining order requires Daniel to stay 100 yards away from Kelly, her mother, the nanny, and Kelly’s home, job and vehicle – “except for brief & peaceful contact as required for court-ordered visitation.”

Last month it was agreed that both parents would attend co-parenting counseling sessions and would share joint legal and physical custody of the two kids.

Gossip Girl’s Kelly Rutherford recently opened up to pro-breast feeding website Best For Babes about breast feeding and her experiences as a first time mother.

The new mom has been very outspoken about her views on breastfeeding. In fact she breast fed her 2 year-old son Hermes throughout her second pregnancy.

Here are a few highlights:

Best For Babes:Did you do anything to prepare or did breastfeeding come as a surprise?

Kelly: I took a class, but at the end of the day, if they are not latching on, then you feel “what’s wrong with me, what’s wrong with the baby.” Then, you have all sorts of experts talk about what’s going on. What I discovered, is that it is very important that the baby breastfeeds right away when she is born. As soon as I gave birth to my daughter, she was right on the boob, and I’ve had no problems. It was a big difference from the first birth, with my son, which was a very long one, so they thought, let me rest a little bit, but then by the time I breastfed him it had been a few hours. With my daughter, obviously the doctor made sure that everything was okay, but I didn’t do all of the procedures they recommend right away, I did the least amount that was necessary that was still healthy, so that my daughter would be able to latch right away.

BfB: How has your son reacted to your daughter and to your breastfeeding her?

Kelly: Well, he’s still nursing too, so they both just nurse.

BfB: Wow! Good for you! Has that helped with the sibling rivalry that sometimes comes with a newborn?

Kelly: I think it’s really helped the transition with the new baby that my son still gets that comfort and that cuddling. I’ve heard that babies that have been weaned when they see you nurse a newborn want to start nursing again.

BfB: Absolutely, toddlers do get jealous sometimes and tandem nursing is a wonderful transitional tool.

KR: I just want to say, to each his own. I know it’s not for everyone. Some people wonder how I do it and isn’t it exhausting but you have to realize it’s not all the time. My son is mostly busy doing other stuff and it’s more of a comfort thing, but it is really cute when they are nursing together. He just looks at her, and checks her out, and puts his hand on her little feet. It gives him this close-up intimate look at her, and it’s very beautiful to see them to kind of get to know each other. When a child is starting to be independent, to be able to come back to the mother and hold on, they are processing things when they are nursing. The world is a big place for us, imagine what it is for them. For children, it’s a nurturing, cuddly place to come back to that’s safe, where they can process the world that they are in. I see my son processing, and my daughter already; they sit, they look at you, they are safe, they have a moment to breathe, to be nurtured.

Gossip Girl star Kelly Rutherford introduces her new bundle of joy Helena to us in this week’s issue of Life and Style Magazine.

Already the mother of adorable 2-year-old son Hermés, Kelly was overjoyed at the idea of having another baby. But her volatile three-year marriage to the children’s father was already at the breaking point.

So when she was three months pregnant, Kelly, 40, made the difficult decision to leave her husband, Daniel Giersch, and have the baby on her own. Their daughter, Helena Grace, was born on June 8 in LA. Now, for the first time since the controversial split, Kelly is speaking out.

“When you’re in labor, you don’t want the man you’re divorcing in there, especially someone who’s said cruel things about you,” she explains.

The couple is still locked up the L.A. courts, as Daniel tries to prevent Kelly from taking Hermes back to New York while she works on Gossip Girl.

“I’m not moving without my kid,” she insists. “I’m not doing anything without my son.”

What’s more, Kelly believes having dad out of the picture altogether wouldn’t be so bad.

“The most important thing is that children have love and stability in their lives, whether that comes from a mother or a father. [Alone], I can raise them to be much more peaceful.”

Congratulations to Kelly Rutherford and estranged husband, Daniel Giersch, on the safe arrival of their second baby – a girl!

Helena Grace Rutherford Giersch arrived last night at 9:20 p.m. weighing 8 pounds, 12 ounces in Los Angeles.

“Kelly and the baby are doing fine,” her rep said.

The Gossip Girl star’s estranged husband, Daniel Giersch, was invited to the hospital but reportedly did not attend his baby’s birth.

Kelly filed for divorce from the Daniel at the beginning of the year and has been embroiled in a bitter custody battle over the unborn child and the former couple’s 2-year-old son, Hermes. Most recently, the pair appeared in court to argue over potty training and gates around Giersch’s swimming pool.

A very pregnant Kelly Rutherford strolled in LA today after a lunch date with Marcia Cross.

After nine long months, Kelly recently admitted she is ready to give birth.

“I can go into labor any moment,” she told Usmagazine at Kidstock Music and Art Festival in Beverly Hills on Sunday.

Although she isn’t due until next weekend, the Gossip Girl star says “it is coming up soon.”

Kelly, who is already mom to son Hermes, has had fun prepping for her new daughter.

“The girls clothes are fun,” she said. “My mom and I have been having a great time with that!”

The actress, 40, says that this time around, she has been resting more but admits she hasn’t stuck to a strict fitness routine like many Hollywood moms-to-be.

“I haven’t exercised once this time,” she admits. “I am so bad. I am like the worst example. I run around after [Hermes] all day and play. We end up going on play dates or in the pool or something. I think I am just so much more active being the mother of a two-year-old.”

Kelly Rutherford and her ex husband Daniel Giersch continued their custody battle of two-and-a-half-year-old son Hermes at Los Angeles County Superior Court yesterday.

The couple are fighting over a list of other parenting issues, including when Hermes, who is set to enter preschool this fall, will be potty-trained.

Yesterday, the couple agreed to have their son wear a pull-up diaper and begin potty training when he “desires.”

Kelly, who is about eight-and-a-half months pregnant with the couples’ second child, said her son began to “change” when his father tried to potty train him.

“He was coming home saying things. I was starting to see definite changes in him,” she told Usmagazine.com outside court. “One person can’t make that decision.”

When asked if she and her ex-husband could have an amicable relationship, the mom-to-be said:

“I don’t see it.

“I have tried everything,” she continued. “I have tried mediation. It is too bad for our son.”

You know things aren’t good when you have to go to court to agree on when to potty train. I can only imagine it will only get worse when the new baby arrives…

Gossip Girl’s Kelly Rutherford gets the cover of this month’s issue of Pregnancy Magazine.

The actress talks to the magazine about her birth plan, motherhood and preparing Hermes for his new sister.

Here are some highlights:

How are you doing?

I’m doing good, I’m doing really well. Since we’ve been in New York, I’ve been working and my tummy’s getting big. She’s movin’ around a lot in there. I’m excited to get back to LA and have the last few months off before I give birth. That will be nice. So I’ll focus on that.

I’ll be done at the end of March and then I can go back to LA and get everything ready for the baby and then I don’t have to come back until July, the baby’s due the first week of June and then I’ll go back to work some time in July. So that will give me enough time to rest and regroup and all of that.

What’s your plan for the birth?

I’ll probably have my mom there and Hermes will be close by and I’ll get a baby nurse too. And I haven’t had, I don’t know if I’m going to do a doula this time, I probably will. I usually labor at home, I’m very close to where I give birth, the hospital and my doctor is so lovely he usually comes to the house and checks on me and everything. It just depends on how this one goes. With Hermes it was a little bit longer, I labored at home a long time before I even went into the hospital and I just try to do it as naturally as possible and be as comfortable as possible. You think you can prepare, but nothing can prepare you for the first time you give birth for that experience because it’s just so extraordinary. So at least now I know a little bit more about what goes on, so I’m excited.

I’ll probably have a doula. I had a doula with Hermes and she was so helpful through the process and I’ll probably call her again when I get back to LA and see if she’s available. Cause it just helps, I think no matter who’s there by your side whether it’s your mother, your husband, whoever, there’s something nice about having that neutral party because they can help and keep everyone else around you together. And they know what’s going on, especially if you’re like me and you kind of want to do a lot at home, it’s nice to have someone that’s knowledgable around.

Does Hermes know what he’s in for?

He does, he’s in and out of it. Sometimes he gets it and he’s into talking about it and sometimes he’s like, “Let’s not talk about that yet.” So we’ll see, I think he’ll be a great older brother. He loves to explain things, so I’m sure he’ll have fun explaining to her how things are, how things work. And I just plan on including him in everything and that’s what my mom did with me and my brother, and I have a great relationship—I was an older sister—so I kind of know and she just really encouraged me to help and be a part of it. And I still do, I’m still probably too much in my brother’s business!

What’s your favorite thing about motherhood?

The smell. The smell thing is huge. The first thing I have to do when I see him is smell him. I just have smell him and kiss him and hold him. It’s kind of t hose instinctual things I guess or just seeing him do something new. Now he’s making sentences and he wants to see everything and point everything and show me what it is. It’s like rediscovering the world again.

What’s your biggest challenge as a mother?

The most challenging thing for me is not to worry. Because there are so many things you think about and worry about and I think it’s natural. And I talk to my girlfriends and they all do it, so I think, “OK, it’s not just me.” Cause sometimes you think it’s just me, I’m just overly worried about things. You want to do the right thing. There’s always an element of you want to do the right thing, am I doing the right thing? I just really try to follow my own instincts and say okay, at least if I follow my own instincts one way or the other I can be accountable for it.
